By placing an order on Heart to Sound, you agree to these Terms of Service. Please read them carefully before purchasing. If you do not agree, do not use our service.
1. About Our Service
Heart to Sound ("we", "us", "our") provides custom personalized song creation services at hearttosound.com. We create original songs based on the information and story provided by the customer.
2. Orders & Payment
All orders are placed through our website and payment is processed securely via Stripe. By completing an order you confirm that:
- You are at least 18 years of age or have parental consent
- All information you provide is accurate and truthful
- You are authorized to use the payment method provided
- Payment is required in full at the time of ordering
Prices are listed in US Dollars (USD). All sales are final upon delivery of the completed song.
3. Delivery
Estimated delivery times are:
- Standard: within 3 days of payment confirmation
- Rush (Premium): within 24 hours of payment confirmation
Delivery times are estimates and may vary in exceptional circumstances. We will notify you promptly if there is any delay. Songs are delivered to the email address provided at checkout.
We are not responsible for delivery failure caused by an incorrect email address provided by the customer.
4. Revisions
We offer revisions as follows:
- Standard package: 3 free revisions
- Premium package: Unlimited revisions
Revisions must be requested within 14 days of delivery. A revision means modifying the existing song — it does not mean creating an entirely new song with a different story or concept.
5. Refunds & Satisfaction Guarantee
Our commitment: We will revise your song until you are satisfied. If after all revisions you are genuinely unhappy with the result, contact us at hello@hearttosound.com within 14 days of delivery and we will work to make it right.
Refunds are considered on a case-by-case basis. We do not offer refunds in the following situations:
- You changed your mind after the song was delivered
- You provided inaccurate or incomplete information in your order
- You did not use the available revisions to address issues
- More than 14 days have passed since delivery
Chargebacks filed without first contacting us will be disputed. We take fraudulent chargebacks seriously.
6. Intellectual Property & Ownership
Upon full payment and delivery of your custom song:
- You receive full ownership and rights to your custom song
- You may use it for personal use, share it on social media, play it at events, or any other personal purpose
- You may not resell the song or claim it was created without the assistance of Heart to Sound
- We retain the right to use anonymized, non-identifiable excerpts of our work as portfolio samples unless you explicitly request otherwise
Our songs are created using professional songwriting and modern music production technology. All creative work — including lyrics — is written by our team.
7. Content Guidelines
We reserve the right to refuse or cancel any order that requests content that is:
- Hateful, discriminatory, or promotes violence
- Sexually explicit or inappropriate
- Defamatory or intended to harm a specific individual
- Illegal or promotes illegal activity
- Harassing or threatening toward any person
If an order is refused for content reasons, a full refund will be issued.
8. Privacy
Your use of our service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Limitation of Liability
Heart to Sound shall not be liable for any indirect, incidental, special or consequential damages arising from the use of our service. Our total liability to you for any claim shall not exceed the amount you paid for your order.
We do not guarantee any specific emotional reaction or outcome from the recipient of the song.
10. Modifications to Service
We reserve the right to modify, suspend or discontinue our service at any time. We also reserve the right to update our pricing and packages. Changes will be communicated via our website.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through good-faith negotiation before any legal action is taken.
12. Changes to These Terms
We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated date. Continued use of our service after changes constitutes acceptance of the updated terms.
